The Telephone Consumer Protection Act ("TCPA") places limits on unsolicited prerecorded telemarketing calls to landline home telephones, and all autodialed or prerecorded calls to wireless numbers, emergency numbers, and patient rooms at healthcare facilities. These calls are known as "robocalls." The FCC recently took steps to further restrict robocalls with new rules that went into effect in December 2012. The Federal Trade Commission (FTC) has issued amendments to the Telemarketing Sales Rule (TSR) in 2003, 2008, and 2010. Like the original TSR issued in 1995, the amended Rule gives effect to the Telemarketing and Consumer Fraud and Abuse Prevention Act. This legislation gives the FTC and state attorneys general law enforcement tools to combat telemarketing fraud, gives consumers added privacy protections and defenses against unscrupulous telemarketers, and helps consumers tell the difference between fraudulent and legitimate telemarketing.

The National Do Not Call Registry

The National Do Not Call Registry

The Federal Trade Commission (FTC) amended the Telemarketing Sales Rule (TSR) to give consumers a choice about whether they want to receive most telemarketing calls. As of October 1, 2003, it became illegal for most telemarketers or sellers to call a number listed on the National Do Not Call Registry.
